1. Acceptance of Terms

By accessing or using RideMyArt.com, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the site.

2. Use of the Site

You may use RideMyArt for personal, non-commercial purposes, such as planning routes, visualizing geographical data, and sharing information with other users for recreational purposes. You may not use the Site to offer commercial services, sell products, or generate revenue without our express written consent.

You are responsible for the content you upload or generate on the platform. You agree not to use the site for any illegal or unauthorized purpose. You agree that we may use your uploaded data in an anonymized and aggregated form to improve the site's functionality, performance, and user experience.

3. Intellectual Property

The website design, code, functionality, trademarks, and copyrights associated with RideMyArt are the property of RideMyArt. You may not reproduce or distribute any part of the site without permission.

You retain ownership of the GPS routes and images you upload. However, you grant RideMyArt a non-exclusive, royalty-free, worldwide license to:

• store, display, process, reproduce, and distribute your content as necessary to provide the site's functionality;
• allow other users to view and interact with your content in accordance with the site's features and settings;
• use your content in an anonymized and aggregated form to improve the site's functionality, performance, and user experience.

This license continues even after you delete your content, to the extent that your content has been shared with others and they have retained copies.

4. Prohibited Activities

You agree not to:

• Upload, post, or transmit any content that is:
  • offensive, defamatory, libelous, harmful, threatening, abusive, harassing, obscene, pornographic, or otherwise objectionable;
  • illegal or violates any applicable law, regulation, or ordinance;
  • infringing on any intellectual property rights (including copyrights, trademarks, patents), or rights of privacy or publicity;
  • contains viruses, malware, or other harmful code;
• Attempt to interfere with the proper functioning of the site or disrupt the servers or networks connected to the site;
• Attempt to gain unauthorized access to any portion of the site, other users' accounts, or any of our computer systems or networks;
• Use any automated means (including robots, spiders, crawlers, scrapers) to access, collect, or download data from the site without our express written permission, except for standard search engine crawlers;
• Reverse engineer, decompile, or disassemble any portion of the site;
• Use the site for any commercial purpose without our express written consent.

5. Disclaimer of Warranties

The site is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the site will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee the accuracy, completeness, or reliability of any content or output generated using the site.

6. Limitation of Liability

To the fullest extent permitted by applicable law, RideMyArt shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including, but not limited to, damages for lost profits, loss of data, or other intangible losses, resulting from:

• your use or inability to use the site;
• any content or services obtained from the site;
• unauthorized access to or alteration of your transmissions or data;
• any errors or omissions in the site's content;
• any other matter relating to the site, even if we have been advised of the possibility of such damages.

7. Pricing, Premium Access & Usage Policy

RideMyArt offers both free and paid features. Access to a limited set of basic images is available at no cost. Additional features such as access to a broader library of premium images and image upload capabilities require the purchase of a paid plan ("Premium").

• Basic Image Route Generation means route generation performed using images designated as “basic” by RideMyArt.
• Basic Download means the download of a route generated using a Basic Image.
• Premium Image Route Generation means route generation performed using premium images provided by RideMyArt or images uploaded by the user.
• Premium Download means the download of a route generated using a Premium Image or a user-uploaded image.

Paid Plans

RideMyArt currently offers the following paid plans:

• Starter: USD 2 for 2 downloads
• Creator: USD 8 for 10 downloads

Users who purchase any paid plan are classified as Premium Users.

Fair Usage Policy

All route generations and downloads are subject to Fair Usage limits. Fair Usage limits are designed to ensure platform stability and fair access for all users. Usage limits apply regardless of whether a generation or download was successful.

Under the Fair Usage Policy:

• Starter (USD 2 / 2 downloads):
  • Up to 50 image generations
• Creator (USD 8 / 10 downloads):
  • Up to 500 image generations

Usage limits apply for the duration of the plan's validity period.

RideMyArt reserves the right to modify Fair Usage limits, restrict excessive usage, or suspend access in cases of abuse or system misuse.

• Starter plan is valid for 183 days from the date of purchase unless otherwise stated.
• Creator plan is valid for 365 days from the date of purchase unless otherwise stated.
• If a user makes an additional paid purchase before the expiry of an existing plan, the validity period for all remaining and newly added downloads, uploads, and generations will reset to the validity period of the latest purchase.
• Unused downloads or generations do not carry over beyond the validity period.
• Premium features are consumed as a combined allowance. If any one of the following limits is fully exhausted: premium downloads or premium generations, access to the remaining Premium features may be restricted unless the user purchases an additional paid plan before the expiry of current plan, even if other allowances remain unused.
• All purchases are non-refundable. No refunds will be issued for unused downloads or generations.
• Payments are securely processed by DodoPayments, our third-party payment processor. RideMyArt does not store payment card details.
• All listed prices are exclusive of applicable taxes, which may be added at checkout depending on your location and local regulations.
• If a payment is declined, reversed, or otherwise fails, we reserve the right to suspend or terminate access to Premium features until the payment issue is resolved.
• We reserve the right to modify pricing, plan features, or usage limits at any time with prior notice. Continued use of Premium features after such changes constitutes acceptance of the revised terms.

8. Termination

We reserve the right to terminate or suspend your access to the site, in our sole discretion, with or without notice, for any reason, including, but not limited to, violation of these terms or misuse of the site. Upon termination, your right to use the site will immediately cease. We may, but are not obligated to, delete your uploaded content following termination.

9. Governing Law and Dispute Resolution

These terms are governed by the laws of India. Any dispute, claim, or controversy arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.

You agree that any dispute will be resolved by binding arbitration. The arbitration will be conducted in English by a single arbitrator appointed in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Bengaluru, India.

10. Changes to Terms

We may update these Terms and Conditions at any time. We will notify you of any significant changes by posting the new terms on this page and updating the “Effective Date” at the top. Your continued use of the site following the posting of changes constitutes your acceptance of the updated terms.
